You expressly agree that your use of, or inability to use any services provided on the Website is at your sole risk. All videos provided via the Website are provided “as is” and “as available” for your use, without warranties of any kind, either express or implied, including all implied warranties of merchantibility, fitness for a particular purpose, title and non infringement.
Warning Login and password may not be shared with anyone. All videos and tutorials are for personal, individual use only. They cannot be used at workshops or meetings and may not be taught under any circumstances without permission from the individual teacher, and not at all in 2016. DO NOT POST PASSWORDS IN ANY FACEBOOK GROUP, TIMELINE OR PAGE. Sharing the password will result in forfeiture of your course.
Acrylic Painting Club OBLIGATIONS
“Acrylic Painting Club” shall use its reasonable endeavors to make the “Service” available to the “User” and its customers 100% of the time but because the “Service” is provided by means of computer and 3rd party telecommunications systems, “Acrylic Painitng Club” makes no warranties or representations that the “Service” will be uninterrupted or error-free and “Acrylic Painting Club” shall not, in any event, be liable for interruptions of the “Service” or “Downtime”. If a teacher does not fulfill with its obligations the Acrylic Painting Club will substitute the project with another of equal or greater quality.
“Acrylic Painting Club” carries out data backups for use by “Acrylic Painting Club” in the event of systems failure. “Acrylic Painting Club” do not provide data restoration facilities for individual “Users”. Even though every effort is made to ensure data is backed up correctly “Acrylic Painting Club” accepts no responsibility for data loss or corruption.
All conditions, terms, representations and warranties that are not expressly stated in this Agreement, whether oral or in writing or whether imposed by statute or operation of law or otherwise, including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded. In particular and without prejudice to that generality, “Acrylic Painting Club” shall not be liable to the “User” or its customers as a result of any “Viruses” introduced or passed on to the “User” or its customers.
INDEMNITY
The Customer agrees to indemnify and hold “Acrylic Painting Club” and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against “Acrylic Painting Club” arising out of any breach by the “User” of the terms of this Agreement or other liabilities arising out of or relating to the services offered.
LIMITATION OF LIABILITY
In no event shall “Acrylic Painting Club” be liable to the “User” for any loss of business, loss of opportunity or loss of profits or for any other indirect or consequential loss or damage whatsoever. This shall apply even where such a loss was reasonably foreseeable or “Acrylic Painting Club” had been made aware of the possibility of the “User” incurring such a loss.
PRIVACY POLICY
Your information will not be shared with any 3rd parties and will only be used by Acrylic Painting Club for administrative and notification purposes.
